Have you ever wondered if you can take your favorite CBD product with you on a plane? The answer is not as simple as a yes or no. In this blog post, we will discuss flying with Delta 8 THC gummies.

CBD and THC are both derivatives of the cannabis plant. CBD is known for its therapeutic properties while THC is the main psychoactive component in marijuana. Both CBD and THC products are derived from hemp plants which contain 0.3% or less of THC.

Since the passage of the 2018 Farm Bill, CBD products derived from hemp plants are now legal in all 50 states. However, there are still many restrictions on flying with these products. The TSA has stated that passengers are allowed to bring CBD products on planes as long as they follow the 3-1-1 liquids rule. This rule states that each passenger is allowed to bring 3.4 ounces or less of liquid, cream, or gel in a single quart-sized bag.

Now that we have reviewed the generalities let’s get specific to Delta 8 gummies. Unfortunately, since Delta 8 gummies do contain THC they would not be compliant with the TSA’s 3-1-1 rule and therefore cannot be brought on a plane.

Products that do contain THC are illegal in many states and are not allowed on planes. Some states have legalized the recreational and/or medicinal use of marijuana; however, it is still illegal at the federal level. The DEA classifies marijuana as a Schedule I drug which means it has a high potential for abuse and no currently accepted medical use. Until federal law catches up with state law, it is best to leave your THC products at home when flying.

Why You Can’t Bring Delta 8 Gummies On A Plane

The Transportation Security Administration (TSA) prohibits all cannabis products—including Delta 8 gummies—from being transported in either carry-on or checked baggage. According to the TSA website, “Possession of marijuana and certain cannabis-infused products, such as CBD oil, is legal in some states but remains illegal under federal law. Federal law supersedes state law.”

This means that even if you’re traveling to a state where cannabis is legal, you still won’t be able to bring your gummies on the plane with you. The TSA’s stance on cannabis has caused quite a bit of confusion and frustration among travelers, especially given the fact that many people aren’t aware that cannabis is still illegal at the federal level.

The next time you are packing for a trip and want to take your favorite CBD product with you, make sure to check if it complies with the TSA’s 3-1-1 rule. If it contains any traces of THC, it is best to leave it at home since it is still illegal at the federal level. Although many states have legalized marijuana, authorities are still working out how to deal with these products in airports and on planes. Until then, it is best to play it safe and leave your THC products at home when flying.
